Acceptance of Terms

By accessing or using the Enlightenment Martial Arts Academy website and services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.

These terms apply to all students, members, visitors, and users of our website, in-person classes, and online content.

Cancellation Policy

Members may cancel their membership at any time for any reason. There are no cancellation fees and no long term contracts.

• To cancel, contact us through the Contact page or you can manage your membership under the my account page.
• Cancellations take effect as soon as you cancle your membership.
• After Cancellation You will not have access to your membership benefits, only purchase history.
• No partial refunds are issued for unused days in a billing period.

Refund & Exchange Policy

At Enlightenment Martial Arts Academy (EMA), we strive to provide quality products, memberships, and services. Please review our refund and exchange policy carefully before making a purchase.

• All apparel, merchandise, accessories, and other products sold through our online store are fulfilled by a third-party supplier. All sales are final. We do not offer refunds, returns, or exchanges for incorrect sizing, ordering mistakes, buyer’s remorse, or other non-defective issues. If your item arrives damaged, defective, or misprinted, please contact us within 30 days of receiving your order. We will work directly with our supplier to review the claim and determine eligibility for a replacement. To submit a damaged item claim, please provide: Your order number A description of the issue Clear photos showing the damage or defect to our email enlightenmentmma@gmail.com. Claims submitted after 30 days may not be eligible for replacement.
• Refund requests for memberships, classes, and services must be submitted within 14 days of the original purchase date. Approved refunds are subject to an $8.00 processing fee. This helps non-refundable payment processing charges incurred at the time of purchase.
• Memberships may be canceled at any time to prevent future recurring charges. Cancellations do not qualify for refunds of previous payments, unused classes, missed sessions, or partially used membership periods.
• Private training sessions canceled less than 24 hours before the scheduled appointment are non-refundable. Online courses are non-refundable once course content has been accessed. Fitness class registrations and program fees are non-refundable once the program start date has been reached or the participant has attended their first class, whichever occurs first.
• To request a refund, use the Refund Request Form. Approved refunds will be processed within 5 to 7 business days to the original payment method. Enlightenment Martial Arts Academy reserves the right to deny refund requests that do not meet these conditions.

Assumption of Risk

Martial arts training, fitness programs, and physical activity involve inherent risks of injury. By participating in any in-person class, private session, or following along with any video content on this website, you voluntarily assume all risks associated with physical activity.

These risks may include but are not limited to: physical injury, muscle strain, joint injury, or other health complications. You agree that you are participating entirely at your own risk.

Enlightenment Martial Arts Academy, its instructors, staff, and affiliates cannot be held responsible for any injury, illness, or harm that occurs as a result of participation in any activity, whether in person or through online video content.

You agree that before participating in any physical activity you will consult with a qualified medical professional if you have any pre-existing health conditions.

Intellectual Property and Content Use

All content on the Enlightenment Martial Arts Academy website, including but not limited to video lessons, written materials, images, logos, and course content, is the exclusive property of Enlightenment Martial Arts Academy and Guy Tinkham.

• You may not copy, reproduce, distribute, or resell any content from this website without express written permission
• Video curriculum content is licensed for personal use only and may not be shared, downloaded for redistribution, or used for commercial purposes
• Unauthorized use or reselling of content will result in immediate termination of membership with no refund
• Legal action may be pursued for unauthorized use or distribution of content

Limitation of Liability

Enlightenment Martial Arts Academy and its instructors, staff, agents, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of our services, website, or content.

This includes but is not limited to injury during in-person training, injury from following video content, loss of data, or any other damages resulting from use of our services.

By using our services you acknowledge that this limitation of liability is a fundamental part of the agreement between you and Enlightenment Martial Arts Academy.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Maine, without regard to any conflict of law principles.

Any disputes arising under these terms shall be resolved in the appropriate courts of Maine.

Changes to These Terms

Enlightenment Martial Arts Academy reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
